We are delighted to have you as a user of our services. Before you proceed, please carefully read and agree to the following Terms of Service:
Acceptance of Terms
By accessing or using Jason's Web Design services, you agree to comply with and be bound by these Terms of Service.
Services
Jason's Web Design offers website design and marketing of related services. The scope of services may vary and will be outlined in the agreement between Jason's Web Design and the client.
Client Responsibilities
Clients are responsible for providing accurate and timely information needed for website development. Any delays in providing necessary content may impact project timelines.
Fees and Payment
Fees for services will be agreed upon before the commencement of any project. Payment terms will be outlined in the agreement. Failure to make timely payments may result in project delays or suspension of services. *Note: Additional fees will be applied to any significant changes needed to the website beyond the agreed upon Go-Live of the website, but of course I will be fair with those fees. Another note is the hosting/maintenance fee are due on the agreed upon date, which is either the 1st or 15th of each month. In the event of a card failure, we will reach out to that client(s) for another payment method. We will give the client a 7 day grace period to pay the amount owed. If there is a hardship or anything that prohibits a successful payment, please reach out to us ASAP and we will do our best to deal with matter that would be fair for both the company and the client.
Intellectual Property
Jason's Web Design retains intellectual property rights to designs and code until full payment is received. Upon payment, clients will own the rights to the finalized website, excluding any third-party elements.
Confidentiality
Both parties agree to keep confidential information shared during the project, including but not limited to business plans, financial information, and proprietary technology.
Termination
Either party may terminate the agreement for just cause, including breach of terms. In the event of termination, all outstanding fees must be paid. I request a 30 day notice upon services being cancelled.
Disclaimer of Warranties
Jason's Web Design provides services "as is," without any warranties. We do not guarantee that our services will be uninterrupted or error-free as there are events that can cause issues with miscellaneous website issues. We do proactively monitor our web servers and client sites regularly and to the best of our ability to keep them up and operational.
Limitation of Liability
Jason's Web Design will not be liable for any direct, indirect, incidental, special, or consequential damages arising out of the use or inability to use our services.
